This privacy policy applies to the SelectionWare.com web site. This privacy policy is effective as of the above date.

Information Collection

Personal Information: During registration a user is required to give contact information. By providing this information to us, you expressly consent to being contacted by us and by service professionals via phone, fax, e-mail, mail or other reasonable means at any of your contact numbers or addresses so that we may provide the services provided on our web site, service your account, reasonably address matters pertaining to your account, or for other reasonable purposes related to our business. Unique identifiers (such as username and password) are required. It is optional for the user to provide demographic information (such as income level and gender) but encouraged so we can provide a more personalized experience on our Web site. If you are a service professional and wish to post a profile about your business, we may also require your social security number or federal tax id number.

Feedback: We also collect ratings, comments and other feedback from users about our web site, the services we provide on our web site, and the performance of service professionals. By providing such feedback to us, you consent to our use, publication and distribution of such feedback without compensation to you. If you are a service professional, you also acknowledge that all such ratings and reviews are solely owned by CPN and you consent to the publication of ratings and reviews about you and your business.

Information Use

Profiles: We store information that we collect through web site activities, cookies, log files, clear gifs, and third parties to create a profile of our users. A user’s profile is tied to the user's personally identifiable information to provide offers and improve the content of the site for the user. This profile is used to tailor a user's visit to the web site and to direct pertinent marketing promotions and communications to them. If you are a service professional and we permit you to post a profile about your business, you consent to our use, publication and distribution of your business profile without compensation to you.

Cookies: A cookie is a piece of data tied to information about the user and stored on the user's computer. We may choose to use both session cookies (which terminate when a user closes his browser) and persistent cookies (which remain on the user's computer until manually deleted). You may decline persistent cookies if your browser permits. If you reject session cookies, you will experience difficulties using the SelectionWare.com web site. However, your experience and access to certain areas of the web site may be denied or limited.

Third party advertising: We may use third-party to serve ads on our behalf and to monitor certain pages of our web site for the purpose of reporting web traffic, statistics, advertisement 'click-throughs', and other activities on our site. These companies may employ cookies and clear gifs (also known as web bugs or web beacons) to measure advertising effectiveness. Any information that these third parties collect via cookies and clear gifs is completely anonymous. Advertisers may use cookies on our web site. We have no access to or control over these cookies once we give permission to set cookies. This privacy statement covers the use of cookies by CPN only and does not cover the use of cookies by any advertisers.

Log Files: Like most web sites, we use log files including internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the Web site, track user's movement in the aggregate, and gather broad demographic information for aggregate use.

Clear Gifs: We employ and our third party advertisers may employ a software technology called clear gifs (also called web beacons or web bugs), that help us better manage content on our site and marketing campaigns by informing us what content and which campaigns are effective. Clear gifs are tiny graphics, about the size of a period at the end of a sentence, with a unique identifier. Clear gifs are similar in function to cookies and are used to track the online movements of users. Clear Gifs can "work with" existing cookies on a computer if they are both from the same web site or advertiser. That means, for example, that if a person visited "www.companyX.com", which uses an advertiser’s clear gif, the web site or advertiser would match the clear gif's identifier and the advertiser’s cookie ID number to track past online behavior for that computer. This collected information would then be given to the advertiser or web site. In addition, CPN and its advertisers may use clear gifs in HTML-based e-mails. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns by showing how many e-mails have been opened by the recipients. Communications from CPN and Service Professionals

Offers and Updates: We send all new members a welcoming e-mail to verify password and username. Established members will occasionally receive information on products, services, and special offers. If you do not want to receive these e-mails, please see the Opt-Out section, below.

Service Announcements: On rare occasions it is necessary to send out a strictly service-related announcement. For instance, if our service is temporarily suspended for maintenance we might send users an e-mail. Generally, users may not opt-out of these communications, though they can deactivate their account.

Customer Service: We communicate with users on a regular basis regarding issues relating to their account via e-mail, fax, phone or mail, and we reply to user inquiries via e-mail or phone, or other reasonable means.

Information Sharing

Submitted Information: When you submit personal information to CPN, you authorize us to share this information with our network of service professionals and advertisers. We may also post and publish users’ ratings and reviews of service professionals and user feedback and testimonials at our sole discretion. We may provide personal information to third parties for the purpose of processing personal information on our behalf. When this is done, it is subject to agreements that oblige those third parties to process such information only on our instructions and in compliance with this Privacy Policy.

Release of Information: Due to the existing regulatory environment, we cannot ensure that all of your communications and other personal information will always remain confidential. We will release personal information if we believe that such action is appropriate to: (a) comply with legal process, (b) enforce the Terms of Use for the SelectionWare.com web site, or (c) identify, contact or bring legal action against persons or entities who may be causing injury to us or a third party, or to otherwise protect the rights, property or personal safety of CPN, its employees, other users of the SelectionWare.com web site, or any other person or entity. Perfect security does not exist on the Internet and we do not guarantee security of information or that unauthorized access will not occur. Your information may be transferred to and maintained in whole or in part on computer networks which may be located outside of the state, province, country or other governmental jurisdiction in which you reside, and may be stored on equipment or in facilities leased or licensed from third parties. In addition, third parties beyond our control may unlawfully intercept or access transmissions or private communications. Therefore, we do not promise, and you should not expect, that your personal information or communications will always remain private.

Requested Information: If you indicate that you want to be contacted by home builders, other service professionals, advertisers, or other third parties, then we may provide your personal information to such third parties. We may also use the personal information we collect to select which names to provide to a particular third party in order to present you with products and services that we believe will be of interest to you. If you participate in the SelectionWare.com service whereby consumers can communicate with home builders and other service professionals regarding scheduling, selection of materials and other information CPN will disclose any or all of such communications to all persons or entities that the consumer, the home builder or other service professional indicates should receive the communication or whom CPN otherwise reasonably believes should have access to the communication.

Aggregate Information: CPN may share aggregated activity or statistical information that does not contain personally identifiable information with any third party.

Business Transitions: In the event CPN goes through a business transition such as a merger, being acquired by another company, or selling a portion of its assets, in most instances users' personal information will be part of the assets transferred.

Links: The SelectionWare.com web site contains links to and from other web sites. CPN is not responsible for the privacy practices of such other web sites. This privacy statement applies solely to information collected by the SelectionWare.com web site.

Information from Service Professionals: CPN may receive personal information about users from home builders or other service professionals. This information may be sent to us either in a batched format, or via Internet technology such as XML, FTP or HTTP Post. This information may or may not be encrypted.

Supplemental Information: Information collected on the SelectionWare.com web site may be combined with information obtained from other CPN web sites and from other companies. For example, in order for us to better conduct our business we may verify or supplement the information we receive from users with information from third party sources. We may also purchase third party marketing data and add it to our existing user database to better target our advertising and provide pertinent offers we think our users would be interested in. This aggregate marketing data is may be tied to a users' personally identifiable information.

Children’s Privacy: The SelectionWare.com web site is a general audience web site targeted to consumers interested or engaged in constructing a home, home builders, other service professionals, advertisers and others interested in or providing products or services relating to the building of homes. The SelectionWare.com web site is not directed to children under the age of 13. We do not collect personal information from any person we actually know is a child under the age of 13. If we become aware that personal information regarding an individual under the age of 13 has been stored, we will promptly delete it from our records.

Access to Your Personal Information

Opt-out: Our users are given the opportunity to 'opt-out' of having their information used for purposes not directly related to our web site at the point where we ask for information. Users who no longer wish to receive our promotional communications may opt-out of receiving these communications by replying to unsubscribe in the e-mail or by e-mailing us at Info@SelectionWare.com, 7425 E. 86th Street, Indianapolis, IN 46256.

Changing and Deleting Personal Information: If a user's personally identifiable information changes (such as zip code, phone, e-mail or postal address), or if a user no longer desires our service, we provide a means to access, correct, update or delete/deactivate users' personally identifiable information. Please note that deleting your account information will not delete all of your contact information or other information contained on our systems. We reserve the right to retain some or all of this information to preserve records of our commercial relationship with you or as required by law. Further, certain information may have already been provided to third parties as described in this Privacy Policy.

Denial of Access: Your rights to access your personal information are not absolute. We may deny access (a) when denial of access is required or authorized by law; (b) when granting you access would have an unreasonable impact on other people’s privacy; (c) to protect CPN’s rights and property; or (d) where the request is frivolous or vexatious. If we deny your request for access to, or refuse a request to correct, personal information, we will explain why.

Changes and Updates

We reserve the right to change this Privacy Policy at any time. Changes to this Privacy Policy will be in writing and be posted on our web site. Please check these terms periodically for changes. The continued use of the SelectionWare.com web site following the posting of changes to this Privacy Policy will mean you accept those changes. Titles and headings are used in this Privacy Policy for general reference and ease of use only.
